Former ICC lawyer says US, Israel do not live up to claim they respect international law
Former International Criminal Court lawyer Geoffrey Nice has responded to Biden’s claim that the US and Israel stand apart from Palestinian fighters in their adherence to international rules and laws.
“President Biden and Israel could do a great deal for the rule of law If they joined up to the International Criminal Court and allowed that court to investigate the legality of both of the occupation to date … and submit peacefully to legal adjudication of what they’re doing,” Nice told Al Jazeera.
“It’s an unhappy reality that Israel is more or less immune from the jurisdiction of the International Criminal Court, and that America will save it if there’s any attempt to refer it there by the [UN] Security Council, and that America itself is not a member of that court,” he said.
Nice added that while the Hamas attack on Saturday was “pretty obviously unlawful”, Israel’s bombardment of Gaza was at the very least “problematic” under international law. Meanwhile, Israel’s announced siege of Gaza brings with it the inevitable risk of starvation, which is “now recognised without any doubt as an international crime”, he said.
